Shawn Buckley Has Submitted NHPPA’s Official Brief to Health CanadaHealth Canada is At it Again. A New Proposal Will Add More Friction Than Ever for Natural PractitionersThe Natural and Non-prescription Health Products Directorate is the federal body within Health Canada that regulates natural health products. NHPPA President Shawn Buckley has submitted a brief to the Natural and Non-prescription Health Products Directorate opposing its proposed NHP Compounding and Raw Materials Policy. Compounding is the preparation of customized natural health products by qualified practitioners to meet the specific needs of individual patients. The proposed policies add new conditions that practitioners must meet for compounding to qualify for exemption from federal rules. These include
These policies are illegal overreach. The Natural Health Product Regulations are clear. Compounding by a health care practitioner is exempt from the definition of manufacturing when the ingredient is a natural health product and is used for a patient. There are only two legal requirements. No other conditions exist in law. The two legal requirements for the compounding exemption under the Natural Health Product Regulations are:
The proposed policies intrude on the practice of medicine. That practice falls under provincial jurisdiction. Health Canada has no constitutional authority to impose them or to insert untrained inspectors into doctor-patient decisions. These changes would restrict practitioners’ ability to access quality ingredients and provide customized treatments. They threaten access to natural health options that many Canadians rely on.
